Mr. Tim Cook

Chief Executive Officer , Apple Inc.
1 Infinite Loop
Cupertino , CA 95014

Dear Mr. Cook :
This incident raises questions about whether Apple ’s iOS app developer policies and recitation may fall short when it come to protecting the info of iPhone user and their contact lens .
The data management section of your iOS developer web site states : “ iOS has a comprehensive accumulation of tools and frameworks for storing , accessing , and sharing data . . . . iOS apps even have access to a gimmick ’s global data point such as contacts in the Address Book , and exposure in the Photo Library . ”[4]The app store inspection guideline section states : “ We review every app on the App Store base on a set of technical , content , and design standard . This limited review criteria is now available to you in the App Store Review Guidelines . ”[5 ] This same section indicate that the guideline are available only to registered members of the iOS Developer Program.[6 ] However , tech blogs following the Path controversy indicate that the Io App Guidelines require apps to get a user ’s permission before “ transmit[ting ] data about a user”.[7 ]

In nastiness of this counsel , claims have been made that “ there ’s a quiet understanding among many iOS app developers that it is acceptable to send a user ’s entire address book , without their permission , to remote servers and then store it for next reference . It ’s unwashed recitation , and many companies probably have your reference book stored in their database . ”[8 ] One blogger claims to have take a resume of developers of pop iOS apps and plant that 13 of 15 had a “ contacts database with millions of records ” – with one claiming to have a database carry “ Mark Zuckerberg ’s cadre phone identification number , Larry Ellison ’s home phone bit and Bill Gates ’ cell sound phone number . ”[9 ]
The fact that the previous version of Path was capable to make headway commendation for distribution through the Apple iTunes Store despite taking the contents of users ’ address rule book without their permission intimate that there could be some trueness to these claim . To more fully sympathize and assess these claims , we are requesting that you respond to the next question :
– Please draw all iOS App Guidelines that concern touchstone related to the seclusion and security of data that will be access or transmitted by an app .

– Please key out how you watch whether an app meets those measure .
– What data point do you consider to be “ data about a drug user ” that is dependent to the essential that the app obtain the exploiter ’s consent before it is transmitted ?
– To the extent not addressed in the reply to question 2 , please name how you make up one’s mind whether an app will convey “ data point about a exploiter ” and whether the consent demand has been met .

– How many iOS apps in the U.S. iTunes Store transmit “ data about a user ” ?
– Do you consider the message of the name and address book to be “ data about a user ” ?
– Do you consider the subject matter of the address book to be data point of the striking ? If not , please explicate why not . Please excuse how you protect the privacy and protection interests of that contact in his or her information .

– How many iOS apps in the U.S. iTunes Store channel information from the address book ? How many of those ask for the user ’s consent before transmitting their impinging ’ entropy ?
– You have built into your equipment the ability to change state off in one place the transmission system of placement entropy entirely or on an app - by - app fundament . Please excuse why you have not done the same for name and address book information .
Please provide the info request no after than February 29 , 2012 . If you have any questions regarding this request , you may get through Felipe Mendoza with the Energy and Commerce Committee Staff at 202 - 226 - 3400 .

Sincerely ,
